Please read these Terms of Service carefully before using arecabooking.com (the "Service") operated by Areca ("us", "we", or "our") and provided by Kinga Pomykała.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By agreeing to these Terms of Service, you represent and warrant that you have not previously been suspended or removed from the Service, and that your use of the Service complies with all applicable laws and regulations.
If you are accepting these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to this agreement.
Areca is a web-based property management system (PMS) and direct booking engine designed for independent hospitality properties including boutique hotels, guesthouses, hostels, and similar accommodation providers. The Service includes, without limitation, reservation management, channel management, a direct booking engine, and any related features or integrations.
Areca offers a free account that allows you to explore and test the Service without a paid subscription. The free account may have limited functionality compared to paid plans. Continued access to full features requires a paid subscription.
If you wish to purchase a subscription, you may be asked to supply billing information including your payment method and billing address. You represent and warrant that: (i) you have the legal right to use any payment method you provide; and (ii) the information you supply is true, correct, and complete.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and handles all customer service inquiries and returns related to billing.
Subscription fees are charged in advance on a monthly basis. Current pricing is published on our pricing page.
We reserve the right to change subscription fees. We will give you at least 30 days' notice of any price change before it takes effect. Your continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.
If payment is not received when due, we may suspend or terminate your access to the Service.
To avoid being charged for a renewal period, you must cancel your subscription before your renewal date. Otherwise, you will be charged and retain access through the end of the billing cycle.
Except where required by law, paid subscription fees are non-refundable. You may contact our support team and, at our sole discretion, we may issue a refund on a case-by-case basis.
Subject to your compliance with these Terms, Areca grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for the lawful management of your property or properties as specified in your subscription plan. You may not use the Service on behalf of third parties or resell access to it without our prior written consent.
You are responsible for all activity that occurs under your account. You must:
You retain ownership of all data you input into the Service ("User Data"), including guest information, reservation records, pricing, and property content.
You grant Areca a limited, non-exclusive license to store, process, and use your User Data solely to the extent necessary to provide and improve the Service. We will not sell your User Data to third parties.
If you cancel your subscription, you may request an export of your User Data within 30 days of termination. After that period, we may delete your data from our servers. We will notify you before any deletion.
Areca acts as an intermediary between your property and connected distribution channels (OTAs, booking portals, and similar third-party platforms). While we work to ensure reliable connectivity, we cannot guarantee the uninterrupted performance of third-party channels and are not responsible for issues arising from the responsiveness, policies, or technical behavior of those platforms.
You are responsible for reviewing and complying with the terms of service of any connected distribution channel. Areca is not liable for any commissions, penalties, or other obligations arising from your use of those channels.
Areca processes guest personal data on your behalf in connection with providing the Service. For the purposes of applicable data protection law, including the General Data Protection Regulation (GDPR), you are the Controller of guest personal data and Areca is the Processor.

The Service, including its software, design, user interface, documentation, and all related content, is owned by Areca and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
You may not copy, reverse engineer, decompile, disassemble, or create derivative works of any part of the Service. You may not use Areca's name, logo, or trademarks without our prior written consent.
We aim to provide a reliable and high-availability Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, emergency maintenance, or circumstances beyond our reasonable control.
We will use reasonable efforts to provide advance notice of planned maintenance. We are not liable for losses arising from temporary unavailability.
The Service may connect to or reference third-party services, including payment processors, OTAs, and other platforms. Areca has no control over and assumes no responsibility for the content, policies, or practices of third-party services. Your use of third-party services is governed by their respective terms and conditions.
To the maximum extent permitted by applicable law, Areca and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the total fees paid by you to Areca in the three (3) months preceding the event giving rise to the claim.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Areca does not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.
You may cancel your subscription at any time. Termination takes effect at the end of the current billing period, after which you will lose access to the Service.

Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination will remain in effect, including sections on intellectual property, limitation of liability, and governing law.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to notify you of material changes. Your continued use of the Service following any changes constitutes acceptance of those changes.

These Terms are governed by the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved in the courts of Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer located in the European Union, you benefit from any mandatory provisions of the law of your country of residence, which cannot be excluded by contract.
